Checked the gearbox oil colour is red like it should be, and its filled, but When I checked it seems to be well overfilled, there is oil above all the lines on the dipstick.

probably best just to drain it and fill it up again. Jack up the front there will bill a bolt in the middle of the gbox sump

About 2litres sits in the gbox sump. once its drained just put 1 litre in check levels and add more if needed.

do you check with engine running or not running?

Checked it with engine not running, and the oil was above the Hot and Cold lines.

proper procedure for checking the autobox fluid is to let it get up to operating temp (so maybe go for a short drive)

then stop the car on a level surface, and put the gear selector in "N"

with the car idling in neutral, check the level of the fluid

Might be worth checking the TPS as well.
A dead TPS can cause lean-out (so power lag) on sudden accel.

how would I check if the tps is working well? i mean how would I know.
