Urgent Help !!!!!! ISCV 4agze help

I have my AE101 4agze ISCV cleaned out however I'm now reasembling it exactly to the way it was and the below the pic shows how it stands. should that black gate on the right be partially opened like it is

Or should it be air tight like this

partially opened but once you turn the ignition on it will move
