This is the official thread which announces an SGM for the Toymods Car Club

Information will be mailed out with the AGM Packs mailed shortly and (assuming that we have your current mailing details) you will receive Voting forms and information for the SGM.

Voting will be held at an SGM prior to the AGM on the Monday 18th of Feburary 2013. All People wishing to vote will also be required to be Financial members for the 2013 year.

Any general questions can be emailed or PM'ed to the Secretary. Any questions relating to a specific postion, and what it entails, that you may be interested in running for can be directed to the current board member in that position.




This Special General Meeting has been called to vote on proposed alterations to the Toymods Car Club Inc constitution to achieve the following

a) Bring the Constitution into alignment with the Associations Act 2009, and

b) Make allowance for online membership applications to the Club.

The Following passages are the current and the proposed alterations to the wording of the Constitution

Alteration (a) - Current

1. Definitions
(1) In these rules:
Director-General means the Director-General of the Department of Fair Trading

Director-General means the Director-General of the Department of services, Technology & Administration.



Alteration (b) – Current

2. Membership qualifications
A person is qualified to be a member of the association if, but only if:
(a) the person is a person referred to in section 15(1) (a), (b) or (c) of the Act and has not ceased to be a member of the association at any time after incorporation of the association under the Act,
or
(b) the person is a natural person:
(i) who has been nominated for membership of the association as provided by rule 3, and
(ii) who has been approved for membership of the association by the committee of the association.

3. Nomination for membership
(1) A nomination of a person for membership of the association:
(a) must be made by a member of the association in writing in the form set out in Appendix 1 to these rules, and
(b) must be lodged with the membership secretary of the association.
(c) must include the sum payable under these rules as entrance fee and annual subscription.
(2) As soon as practicable after receiving a nomination for membership, the membership secretary must refer the nomination to the committee which is to determine whether to approve or to reject the nomination.
(3) As soon as practicable after the committee makes that determination, the membership secretary must:
(a) notify the nominee, in writing, that the committee approved or rejected the nomination (whichever is applicable), and
(4) the membership secretary must, on payment by the nominee of the amounts referred to in clause (1) (c) within the period referred to in that provision, enter the nominee’s name in the register of members and, on the name being so entered, the nominee becomes a member of the association.

Alteration (b) – Proposed

2. Membership qualifications

(4) the membership secretary must, on payment by the applicant of the amounts referred to in Section 8 within the period referred to in that provision, enter the applicant’s name in the register of members and, on the name being so entered, the applicant becomes a member of the association.



Alteration (c) – Current

8. Fees and subscriptions

(1) A member of the association must, on admission to membership, pay to the association a fee of $10 or, if some other amount is determined by the committee, that other amount.
(2) In addition to any amount payable by the member under clause (1), a member of the association must pay to the association an annual membership fee of $30 or, if some other amount is determined by the committee, that other amount:
(a) except as provided by paragraph (b), before 1 February in each calendar year, or
(b) if the member becomes a member on or after 1 February in any calendar year – on becoming a member and before 1 February in each succeeding calendar year.

(3) A member’s Annual Subscription shall be due and payable on the 12 month anniversary of their membership joining date.

The short version of the above is The board is altering the constitution to remove the requirement to be nomminated to be a Club Member, and also remove the "all memberships expire 31st Jan", the plan moving forward is to have memberships expire 12 months after the join date to ease the burden on the membership secretary.
